A comprehensive legal framework exists at European Union level including directives and regulations on the use of GMO's within the European Union. For an outline of the EU legislative framework reference is made to the fifth national report of the European Union. As a member of the European Union Denmark has implemented the EU directives and enforces the EU regulations by means of national laws and executive orders. The use of genetic engineering in Denmark is regulated in Danish Act on environment and genetic engineering (Consolidated Act no. 9 of 04/01/2017, https://www.retsinformation.dk/eli/lta/2017/9). The act covers the national implementation of Directive 2001/18/EC of the European Parliament and of the Council of 12 March 2001 on the deliberate release into the environment of genetically modified organisms and EU Directive 2009/41/EC on the contained use of genetically modified microorganisms. Rules on commercial cultivation or prohibition thereof, handling, sale and transport of genetically modified crops are given in Act on cultivation, etc., of genetically modified crops (Consolidated Act no. 28 of 04/01/2017, https://www.retsinformation.dk/eli/lta/2017/28). Foods containing or produced from a genetically modified organism (GMO) are subject to common EU rules on approval and labelling (Regulation (EC) No 1829/2003 of 22 September 2003 on genetically modified food and feed and Regulation (EC) No 1830/2003 of 22 September 2003 on the traceability and labelling of genetically modified organisms and the traceability of food and feed produced from genetically modified organisms). Penal provisions for violating these rules are provided in Danish Executive Order no 641 af 13/05/2015 on Penalties for Violations of Certain Regulations on Genetically Modified Foods (https://www.retsinformation.dk/eli/lta/2015/641). The Danish Veterinary, Food, Agriculture and Fisheries Agency administers rules on release and marketing of GMOs, including non-edible crops, medicines and vaccines that contain or consist of GMOs, and rules on GMOs used as feed or food, including the cultivation of products that are used as feed or food. The Danish Environmental Protection Agency (Ministry of Environment and Gender Equality) administers rules on the contained use of GMOs, where GMOs are cultivated in closed systems for production and research, including in tanks.

A comprehensive legal framework on import of GMOs intended for direct use as food or feed, or for processing, exist at EU level. This EU regulation applies directly in Denmark. Decisions for placing on the market of LMOs intended for direct use as food or feed or for processing are taken at EU level and not by the Member States individually. The European Union legislative framework on GMO’s addresses all issues covered by the Cartagena protocol. The Danish administration of export and import of GMO’s is regulated in accordance with the EU framework. The national focal point for the Cartagena Protocol is placed in the Danish Veterinary, Food, Agriculture and Fisheries Agency (Ministry of Food, Agriculture and Fisheries). This agency is responsible for enforcing EU legislation on deliberate release into the Environment and marketing of GMO’s and legislation on genetically modified food and feed (incl. import). The Danish Environmental Protection Agency (Ministry of Environment and Gender Equality) and the Danish Working Environment Authority (Ministry of Employment) are responsible for enforcing EU legislation concerning the contained use of GMO’s.

The three cases referred to concern the unintentional export/import of genetically modified organisms (genetically modified GloFish (three observations in three EU Member States), GM Norfolk Purple Tomato and GM Linseed). It was not considered likely that these incidents could have significant adverse effects on biological diversity.

In our experience, socio-economics are very difficult to take into consideration in the decision making process because it is very hard to define and measure any possible socio-economic impacts of an import of a GMO. However, the Danish Act on Environment and Genetic Engineering (Consolidated Act no. 9 of 04/01/2017, https://www.retsinformation.dk/eli/lta/2017/9) states, that ethical considerations and respect for people's living conditions should be taken into account when deciding upon matters concerning GMOs.

A key element in the Danish legislation on co-existence between GM-crops and conventional and organic crops (Danish act no. 28 of 04/01/2017 on cultivation etc. of genetically modified crops) are the provisions that provide financial security from damage from genetically modified material cf. the Act, §§ 9 (compensation for farmers who suffer losses due to the presence of genetically modified material in their crops), 10 (reporting a claim for compensation), 15 (payment for taking samples and for analyses to be used in connection with the application for compensation) and 16 (rules on access to appeal of decisions taken by an Authority), and accompanying Administrative order on compensation of loss caused by certain occurrence of genetically modified material, BEK 744 of 30 May 2022 (https://www.retsinformation.dk/eli/lta/2022/744) (Cf. information given by Denmark in response to CBD Notification 2023-109).
